Welcome to VibeNest.

These Terms of Service ("Terms") govern your access to and use of VibeNest, including vibenest.app, VibeNest profiles, account features, paid features and any related services we provide (collectively, the "Service").

By creating an account, accessing or using the Service, you agree to these Terms, our Privacy Policy, Community Standards and any other policies that apply to your use of VibeNest.

If you do not agree to these Terms, you must not use VibeNest.

1. What VibeNest is

VibeNest is a profile and link-sharing platform that allows users to create and customise a personal page, display links and content, connect accounts, add media and music, customise visual elements and access analytics and other features.

Some features are free. Additional features may be available through VibeNest PRO or other paid or promotional access.

VibeNest does not own or control the third-party websites, platforms, products or services that users link to from their profiles.

2. Who may use VibeNest

You must be at least 13 years old, or the higher minimum age required by the laws of your country, to create or use a VibeNest account.

Users aged 13–15

If you are between 13 and 15 years old:

• you must have permission from a parent or legal guardian to use VibeNest;
• additional age-appropriate safety, privacy and feature restrictions may apply to your account;
• you may not add, promote or link to adult or sexually explicit content;
• some features may be unavailable or restricted for safety, privacy or legal reasons.

Your parent or guardian should review these Terms with you.

Users aged 16–17

Users aged 16 or 17 may generally use VibeNest, subject to age-appropriate restrictions and any parental or guardian consent required by applicable law.

Purchases by minors

If you are under 18, you may only purchase VibeNest PRO or any other paid feature with the permission of your parent or legal guardian.

We may take reasonable steps to verify age, obtain appropriate consent or restrict features where required for safety or legal compliance.

3. Your account

You must provide accurate information when creating and maintaining your account.

You are responsible for:

• keeping your login credentials secure;
• maintaining control of your account;
• activities performed through your account; and
• notifying us if you believe your account has been compromised.

You must not share, sell, transfer or commercially trade your VibeNest account or username.

We are not responsible for losses resulting from your failure to keep your account secure, except where the loss results from our own breach of applicable law or obligations that cannot legally be excluded.

4. Multiple accounts

A user may normally operate up to two VibeNest accounts.

We may allow additional accounts where there is a legitimate reason, such as separate projects, brands, communities or other reasonable use cases.

Creating additional accounts to evade a suspension, ban, restriction, username rule, rate limit or enforcement action is prohibited.

We may remove or restrict additional accounts created for abusive or deceptive purposes.

5. Usernames

VibeNest usernames are generally provided on a first-come, first-served basis.

A username does not give you ownership of a word, name, trademark or identity.

We may remove, reserve, rename or reassign usernames where reasonably necessary, including where a username:

• impersonates another person, organisation or brand;
• infringes intellectual property rights;
• is misleading or deceptive;
• violates our Community Standards;
• is being held primarily for resale or username squatting;
• is associated with abuse or ban evasion;
• is required for VibeNest operations; or
• belongs to an account that has been inactive for at least 12 months.

Where reasonably possible, we may attempt to contact an inactive account holder before reclaiming a username.

Fan, parody or commentary accounts may be allowed where they are clearly identified as such and do not mislead people into believing they are the official person, organisation or brand.

6. Your content

"Content" includes anything you upload, display, submit, embed, link or otherwise make available through VibeNest, including:

• usernames and display names;
• biographies and text;
• images and avatars;
• GIFs;
• videos;
• audio and music links;
• backgrounds;
• fonts;
• custom cursors;
• links;
• social accounts; and
• other profile materials.

You keep ownership

You retain ownership of your Content.

VibeNest does not take ownership of your Content merely because you upload it to the Service.

You are responsible for ensuring that you own your Content or have all permissions, licences and rights necessary to use and display it through VibeNest.

Licence required to operate VibeNest

By uploading or publishing Content, you give VibeNest a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, technically modify, transmit and publicly display that Content only as reasonably necessary to:

• provide your VibeNest profile;
• operate the Service;
• optimise Content for different devices or formats;
• provide requested VibeNest features;
• secure and maintain the Service; and
• comply with applicable law.

This licence does not transfer ownership of your Content to us.

It ends when the Content is permanently deleted from the Service, except where limited retention is technically or legally necessary.

Marketing use

We will not use your profile, identity, images or other Content in VibeNest advertising or promotional campaigns simply because your profile is public.

If we want to feature your Content for marketing or promotional purposes, we will request your permission first.

7. Content you must not publish

Your Content and use of VibeNest must comply with our Community Standards.

Among other things, you must not use VibeNest to publish, promote or facilitate:

• illegal activity;
• malware or malicious software;
• phishing;
• credential theft;
• IP grabbers or similar deceptive tracking tools;
• scams or fraud;
• threats or targeted harassment;
• impersonation intended to deceive;
• sexual exploitation;
• child sexual abuse material;
• terrorist or violent extremist activity;
• unlawful hate or discriminatory abuse;
• content that infringes another person's intellectual property rights; or
• other content prohibited by our Community Standards.

Serious violations may result in immediate removal or permanent suspension without prior warning.

8. Adult and sensitive content

Sexually explicit pornography may not be uploaded, hosted or directly displayed as Content on a VibeNest profile.

Users aged 18 or older may link to certain lawful external adult content where:

• the content and link are legal in the relevant jurisdictions;
• the link complies with our Community Standards;
• appropriate sensitive-content labelling or warnings are used where required; and
• the content does not involve exploitation, minors, non-consensual material, illegal services or other prohibited activity.

Users under 18 may not publish or promote links to adult or sexually explicit content.

We may restrict, age-gate, label, remove or disable access to sensitive material where reasonably necessary.

Detailed rules are set out in our Community Standards.

9. Third-party links and services

VibeNest profiles may contain links to third-party websites, applications, platforms or services.

VibeNest does not control these third parties and does not endorse them merely because they appear on a VibeNest profile.

When you leave VibeNest, the third party's own terms, privacy practices and policies apply.

To the extent permitted by law, VibeNest is not responsible for:

• third-party websites or services;
• their availability or security;
• purchases made through them;
• information you provide to them;
• scams or misleading content operated by third parties; or
• losses arising from transactions between users and third parties.

You should review third-party services before interacting with them.

10. Commercial use and external transactions

You may use your VibeNest profile for personal or commercial purposes.

You may link to businesses, shops, products, services, affiliate programmes or referral offers provided that they are lawful and comply with these Terms and our Community Standards.

VibeNest is not the seller, buyer, agent, broker or party to transactions made through external links unless we expressly state otherwise.

Any dispute concerning an external transaction is between the relevant users, seller, platform or service provider.

Certain regulated or higher-risk categories may be restricted or prohibited under our Community Standards even if they are lawful in some locations.

11. Copyright and intellectual property

You must respect the intellectual property rights of others.

You may not upload or display images, videos, fonts, music, trademarks or other protected material unless you own it or have permission to use it.

If we receive a valid copyright, trademark or other intellectual-property complaint, we may:

• investigate the report;
• temporarily restrict the Content;
• remove or disable the Content;
• request additional information;
• notify the affected user; or
• take action against repeat infringers.

Where an applicable copyright takedown procedure, including a DMCA procedure, applies, we may process the request in accordance with that procedure.

Intellectual-property complaints may be submitted through our Report Violation process or to:

Submitting knowingly false or misleading infringement reports is prohibited.

12. VibeNest intellectual property

Except for user Content and third-party materials, the VibeNest Service — including its software, code, design, interface, graphics, logos, branding and original materials — belongs to VibeNest or its licensors.

Using VibeNest does not give you ownership of our intellectual property.

You may not copy, sell, reproduce or exploit substantial parts of the Service except where permitted by law or with our written permission.

13. Bots, scraping and abuse of the Service

You must not:

• use bots to create accounts in bulk;
• scrape VibeNest without authorisation;
• bypass rate limits or security systems;
• attempt to access accounts or systems without permission;
• interfere with the normal operation of the Service;
• conduct denial-of-service attacks;
• probe or exploit security vulnerabilities;
• automate abusive activity;
• evade moderation or enforcement systems; or
• use VibeNest infrastructure in a way that materially harms the Service or other users.

Automated access may be permitted where we expressly authorise it or provide an official API or integration.

14. VibeNest PRO

VibeNest may offer a paid upgrade called VibeNest PRO.

At the date of these Terms, VibeNest PRO is offered as a one-time purchase rather than a recurring subscription.

The current price and included features are displayed on the VibeNest Pricing page before purchase.

Payment is processed through Stripe or another payment provider identified at checkout.

We do not normally receive or store your complete payment-card information.

Activation

PRO access is activated after our payment processor confirms successful payment.

Refunds

Except where required by applicable law, VibeNest PRO purchases are final and non-refundable once access has been provided.

Nothing in these Terms removes any cancellation, refund, consumer or statutory rights that you cannot legally waive.

If the law where you live gives you mandatory cancellation or refund rights, those rights continue to apply.

Account bans

If your account is suspended or permanently banned because you seriously or repeatedly violated these Terms or our Community Standards, your PRO access may also be terminated without refund, except where applicable law requires otherwise.

Transfers

PRO belongs to the account on which it was purchased and cannot normally be transferred to another account.

Changes to PRO

We may add, improve, replace or remove individual PRO features as VibeNest evolves.

We will not deliberately remove the fundamental substance of a paid PRO purchase without a legitimate reason or without respecting any mandatory consumer rights that apply to you.

Future pricing

We may change the price of PRO for future purchases.

A price change does not create a new payment obligation for users who already purchased the one-time version of PRO.

Complimentary PRO

PRO access granted manually, promotionally or without payment may be subject to different conditions and may be modified or withdrawn where appropriate.

15. Analytics

VibeNest may provide analytics such as profile views, link clicks, destination performance or similar metrics.

We make reasonable efforts to provide accurate analytics, but analytics may contain delays, filtering, technical differences, incomplete events or measurement errors.

Analytics are therefore provided for informational purposes and are not guaranteed to be perfectly accurate or continuously available.

16. Account deletion

You may request deletion of your VibeNest account through the available account controls.

When deletion is requested:

1. your public profile will become unavailable;
2. the username will be temporarily reserved;
3. the account will enter a 7-day deletion period;
4. during those 7 days, you may be able to cancel the deletion and recover your account; and
5. after the 7-day period, the deletion becomes permanent and the account cannot normally be recovered.

After permanent deletion, the username may become available for registration by another user.

We will delete your account data and user Content from our active systems in accordance with our Privacy Policy.

Limited information may be retained where reasonably necessary or legally required, including for:

• financial or transaction records;
• fraud prevention;
• security;
• legal claims;
• regulatory obligations;
• enforcement records; or
• other purposes required by law.

Any such retention will be limited to what is reasonably necessary and will be explained further in our Privacy Policy.

17. Moderation, suspension and termination

We may investigate Content or account activity where we reasonably believe these Terms, our Community Standards or applicable law may have been violated.

Depending on the circumstances, we may:

• remove Content;
• disable individual links;
• add warnings;
• restrict features;
• restrict visibility;
• temporarily suspend an account;
• permanently terminate an account;
• preserve relevant information where legally necessary; or
• report activity to competent authorities where required or appropriate by law.

We may act immediately without prior warning where there are serious grounds, including:

• malware;
• phishing;
• fraud;
• threats to users or the Service;
• sexual exploitation;
• child safety risks;
• ban evasion;
• serious illegal activity;
• repeated violations; or
• a legal requirement to act.

For less serious issues, we may provide warnings or an opportunity to correct the problem where appropriate.

18. Appeals

If your account or Content is restricted, suspended or removed, you may be able to appeal the decision.

Appeals may be submitted through our support or reporting system or to the contact method identified in the enforcement notice.

We may request additional information before deciding an appeal.

An appeal does not guarantee that an enforcement decision will be reversed.

We aim to review appeals fairly and may restore Content or accounts where we determine that an enforcement action was incorrect or no longer necessary.

19. Availability and changes to VibeNest

We continually develop VibeNest.

We may add, modify, replace or discontinue features, limits, designs or parts of the Service.

We may also temporarily suspend parts of the Service for maintenance, security, technical problems or other operational reasons.

We do not promise that VibeNest will always be available without interruption, delay or error.

Where a change materially affects a paid feature or consumer right, we will act reasonably and comply with applicable law.

20. Disclaimer

We aim to provide a safe and reliable Service, but internet services can experience interruptions, errors and security incidents.

To the maximum extent permitted by applicable law, VibeNest is provided on an "as available" basis.

We do not guarantee that:

• the Service will always be uninterrupted;
• every error will immediately be fixed;
• third-party links will remain available;
• user Content will always remain accessible;
• analytics will be completely accurate; or
• the Service will meet every particular user's requirements.

Nothing in this section excludes any guarantee, warranty or consumer right that cannot legally be excluded.

21. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes liability for:

• death or personal injury caused by negligence where liability cannot lawfully be excluded;
• fraud or fraudulent misrepresentation;
• deliberate wrongdoing where liability cannot lawfully be limited; or
• any statutory or consumer right that cannot legally be excluded or limited.

Subject to those exceptions, and to the maximum extent permitted by law, VibeNest will not be responsible for indirect or consequential losses that were not reasonably foreseeable when you agreed to these Terms.

Where we are legally permitted to limit our total financial liability to you, our aggregate liability relating to the Service will not exceed the greater of:

(a) the amount you paid directly to VibeNest during the 12 months immediately before the event giving rise to the claim; or
(b) £100 GBP.

This limitation applies only to the extent that it is lawful and fair under the laws applicable to you.

22. Reporting violations

If you believe a VibeNest profile or user violates these Terms or our Community Standards, you may submit a report through our Report Violation process.

Reports may include issues such as:

• impersonation;
• scams;
• phishing;
• harassment;
• illegal content;
• copyright infringement;
• trademark infringement;
• child safety concerns;
• adult-content violations; or
• other Community Standards violations.

Reports should be made in good faith.

Submitting intentionally false, abusive or misleading reports may itself violate these Terms.

23. Changes to these Terms

VibeNest may update these Terms as the Service, our business or applicable laws change.

When we make a material change, we will take reasonable steps to notify affected users, such as by:

• displaying a notice on VibeNest;
• updating the date at the top of these Terms;
• providing an account notification; or
• sending an email where appropriate.

Urgent changes required for legal, security or abuse-prevention reasons may take effect immediately.

If you continue using VibeNest after updated Terms take effect, you agree to the updated Terms.

If you do not agree to a material change, you may stop using VibeNest and delete your account.

Nothing in this section permits us to remove mandatory consumer rights.

24. Privacy and cookies

Our Privacy Policy explains how VibeNest collects, uses, stores and protects personal information.

Our Cookie Notice explains how cookies and similar technologies are used.

By using VibeNest, you acknowledge that these policies apply to your use of the Service.

25. Governing law and disputes

These Terms are governed by the laws of England and Wales.

However, VibeNest is available globally.

If you are a consumer living outside England and Wales, nothing in these Terms removes mandatory rights or protections you may have under the laws of the country where you live.

Where applicable law gives you the right to bring a dispute before the courts of your country of residence, these Terms do not remove that right.

Otherwise, disputes relating to these Terms or the Service will be subject to the jurisdiction of the courts of England and Wales.

26. General terms

Entire agreement

These Terms, together with our Privacy Policy, Community Standards and other policies expressly incorporated into them, form the agreement governing your use of VibeNest.

No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently give up the right to enforce it.

Severability

If part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Assignment

You may not transfer your VibeNest account or your rights under these Terms without our permission.

If ownership or operation of VibeNest changes in the future, these Terms and associated rights and obligations may be transferred to the successor operator as permitted by law.
